On Conflict And Coordination Between Privacy And Freedom Of Expression Of Public People

Privacy is an important basic right of citizens.Under the influence of the country’s commitment to the rule of law to promote the construction of a country under the rule of law,citizens have become more and more aware of safeguarding their rights and interests.Frequently,we can see lawyers’ letters about the infringement of their privacy and reputation released by the studios of certain public figures through the network platform.With the rise of the Internet and the shift of the focus of public interest,public figures are frequently flooding into people’s lives,narrowing the distance between ordinary citizens and public figures and creating conflicts at the same time.While enjoying the benefits of the Internet in this era of top-notch traffic,public figures can also take on some unfavorable comments.As for the legal boundary between the privacy rights of public figures and the freedom of speech such as the public and the media,it is necessary for the law to provide clear and systematic provisions to balance the relationship between the two and ultimately safeguard the vital interests of different rights subjects.But in our country’s judicial practice most of the time to rely on the judge’s discretion,is not conducive to people to obtain a fair and just legal protection.Through the interpretation of the right of privacy and freedom of speech of public figures,as well as the use of comparative law to investigate the provisions and practices of foreign countries on the relationship between the two,this paper makes a superficial discussion on the conflicts between the two and the value of rights behind them,hoping to contribute to the relevant legislation and judicial practice.
