With the deepening of information technology in the application field,people’s economic life has undergone profound changes.The platform economy has gradually changed from a section of "Internet +" to a major project that accelerates the development of advanced manufacturing industries.An economic model and economic phenomenon.Under the platform economic model,the platform-based enterprises and the atypical laborers in the platform enterprises will gradually become the new force of economic life,and the “modern labor” pattern established since the industrial revolution is being broken.In practice: ride-hailing drivers and platform companies,online anchors,live broadcast guilds and live broadcast platforms,takeaway riders,third-party companies and takeaway platforms are encountering the lack and dilemma of referee rules and referee standards;in theory: the platform economic model The atypical labor relationship under this situation has made China’s labor law undergo a multiple test of legislative technology,the rule of law and legal ethics: different cases of the same case frequently occur;the fact that laborers have difficulty in protecting labor laws;platform companies face institutional barriers during the transition;The characteristics and purpose of the labor law to protect the weak are gradually lost.These problems are all revealed: Under the platform economy model,labor law thinking needs to be reformed,and the traditional labor relationship theory that is “one size fits all” needs to be enriched and broken.After in-depth exploration of extra-territorial system experiences such as "non-employee laborers","dependent contractors","Borellotest rule system","class employees","quasi-subordinate attributes","contract labor",this article attempts to explore and propose ""Concept of cloud labor relations".The "cloud labor relationship" should be changed from "stance" and "thinking",and it should be constructed from the identification of cloud workers,the identification of multiple cloud labor relationships,and improvement of related supporting facilities.
