Study On Criminal Law Regulation Of Cult Crime

The problem of cult crime is a worldwide problem.The causes of cults in China are more complicated.Firstly,the psychological impact caused by social transformation,secondly,the imbalance between spiritual and cultural life and material development,and finally,the government’s prevention and control of cults is weak.All these determine that cults will exist for a long time in China,and the governance of cults will be a long-term issue.Cult nature determines the perversion of cults crime mode of thinking,behavior patterns,the extreme fanatical,group of crime,crime of concealment and brutal behavior,thus to national security and public security,civil rights have extremely high hazard,strict governance cult remains current the important tasks of protecting public interests of the state and people.This paper is divided into four chapters:the first chapter starts with the comparative analysis of the two main concepts of heresy and heresy crime,analyzes the characteristics and classification of heresy crime,and expounds the harm of heresy crime to national security and public security as well as personal safety of citizens.The second chapter carries on the analysis of the current situation of cult crime in the first chapter,and introduces the current situation of criminal law regulation of cult crime in China,from the historical legislative origin to the relevant legal provisions of criminal law to the latest judicial interpretation.Finally,it concludes that there are two problems in the criminal law regulation of cults in China: the constitution requirement is defective and the criminal law is maladjusted.The third chapter examines and analyzes the legislation of cult crime in France,the United States and Japan,and seeks enlightenment and reference from three different governance modes.The fourth chapter,according to the preceding foreshadening,in view of the shortcomings of the criminal law regulation of China’s evil cult crime,combined with the legislative enlightenment of foreign evil cult crime,so as to put forward Suggestions to improve the criminal law regulation of China’s evil cult crime.First of all,this paperanalyzes the feasibility and necessity of the legislation of the criminal law of cult in China,then proposes to expand the scope of the subject of the crime of cult,construct the criminal system of the crime of cult,and adopt the legislation model of the criminal law to improve the criminal law regulation measures of the crime of cult in China.
