After the third Plenary session of the 18th CPC Central Committee,the court system made a fully new attempt on the classified management of internal personnel and carried out the reform of the selected of judges system.At present,the central government does not have detailed provisions on the withdrawal mechanism of selected of judges,and all localities are also moving forward in the process of groping forward,and a unified standard has not yet been formed.As a result,there is a deviation in the implementation of the system,and there is a "only coming into not getting out of" dilemma in the management of selected of judges,which greatly reduces the effect of judicial reform.In this paper,the management of "selected of judge",a special subject of civil servants,is mainly made a study,the establishment of a smooth way for selected of judges to withdraw is made a discussion,in addition to it,it’s to carry out the dynamic management of survival of the fittest so as to realize the beneficial cycle of a team of judges.It’s found out the bottleneck problem that restricts the withdrawal system management of grass-roots court at present by summing up the concrete practice of representative grass-roots courts in China,investigating the evaluation of judges in55 grass-roots courts,and making an analysis of the shortcomings and reasons for the implementation of the withdrawal mechanism of selected of judges in District A of Tianjin.Some policy suggestions in line with the characteristics of personnel management in grass-roots courts are proposed by means of the comprehensive application of new public management theory,performance management theory,organizational balance theory,threat incentive theory and other related theories: with regard to the construction of the withdrawal mechanism of selected of judges in grass-roots courts,it is necessary to establish a special organization for the management of selected of judges,to clarify the path of withdrawal of selected of judges,to implement dynamic evaluation and management of judges,and to establish relief measures for refunded judges,to ensure occupational security for refunded judges,in addition to it,it is necessary to establish an effective supervision mechanism of the third party and form an organic and unified mechanism system for the withdrawal of selected of judges.These suggestions will provide a useful reference for the design of the relevant system of the grass-roots courts in our country,and make up for the management blank of the special subject,such as "selected of judge" at present. |
