Legal Research On The Problem Of The Young Volunteers’ Rights And Interests In China

Volunteer service has a long history in the world,and is an indispensable and important part in modern civil society.Since 1970’s,western volunteer activities have entered a period of rapid development.They have more research and practical experiences in volunteer rights and interests.They have formed a more standardized legal system and mature safeguard model.Chinese youth volunteer service have took shape in the early 1990’s,and attracted extensive attention after the Wenchuan earthquake in 2008.However,the legislation of youth volunteer service is lagged behind,the relevant policies and regulations are still not perfect.All of the above have affected the sound and orderly development of volunteer service in China.The purpose of this paper is to investigate the practices and shortcomings of our country in the protection of the rights and interests of young volunteers.By the mean of comparative analysis,this paper focusing on the legislation on the protection of young volunteers at home and abroad.With analyzing the local practices in the protection and the laws of the virtue,this paper puts for ward the suggestions for improving the rights and legislative suggestions,which is a role in providing legal theoretical support for the protection of the rights and interests in young volunteers.Legislation on the protection of young volunteers’ rights and interests in China is an inevitable requirement for ruling the country by law and building a socialist country ruled by law.It is urgent to bring the protection into the legal track.Legislation on the protection of the rights and interests of young volunteers should clarify the rights and obligations of young volunteers,clarify the legal responsibilities of the relevant responsible persons,and clarify the channels of rights relief,such as clarifying the legal status of young volunteers,improving the protection mechanism,and improving the risk management.And this should create a good legal environment for volunteer service,encourage young volunteers to move steadily on the road of public welfare,and promote the youth volunteer service to institutionalization and legalization.
