Research On Criminal Law Of Crime Of Infringing On Citizen's Personal Information In China

Nowadays,with the rapid development of information technology and application,personal information has become an increasingly important resource in social development,and the economic value has become increasingly prominent.Accompanied by this is the increasingly serious crime situation of infringing on citizens' personal information.The number of cases of infringing on citizens' personal information is increasing,the means of crime are becoming more diversified and high-tech.What is more,the crime has formed a complete interest chain in China,which seriously threatens citizens' personal and property rights?Due to the lagging of relevant legislation and judicial interpretation in China,the crime is faced with many difficulties in judicial practice.In this context,in 2017,the Supreme People's Court and the Supreme People's Procuratorate jointly issued the Interpretation of Several Questions Concerning the Application of Law in Criminal Cases of Infringing on Citizen's Personal Information(hereinafter referred to as "Interpretation"),"Interpretation of Two High Levels","Interpretation","Two High Levels","Interpretation","Two High Levels","Interpretation" made further clarification on the mode of To a certain extent,it solves the difficult problems in the judicial application of the crime,and helps to realize the accuracy and stability of the crime in judicial practice.However,from the content of "Two High" and "Interpretation",some problems in judicial practice still need to be solved.Based on the specific provisions of the Amendment to the Criminal Law(9)and the Interpretation of the "Two Higher Levels",this article will sort out the legislative evolution and the constitutive elements of the crime of infringing upon citizens' personal information,analyze the boundaries between the crime and other related crimes,and discuss the problems in the judicial application of the crime in depth.Finally,based on the national conditions of our country and drawing on the experience of other countries,the state-owned policy will be adopted.Put forward the relevant countermeasures to sex,and provide reference for solving the difficult problems of the crime of infringing on citizens' personal information in the judicial application of our country.
