| The communication industry is a natural monopoly industry,which has been accompanied by a monopoly nature since its birth.China’s communications industry is controlled by three major operators,which earn monopoly profits through price packages.The price package monopoly is based on the natural monopoly of the communications industry,the need to maximize operator benefits,and the impact of consumer psychology.The monopoly of price packages violates the order of free and fair competition,violates the principle of good faith,violates the rights and interests of legal operators,consumers,and public interests,and hinders technology research and development.As the current law in our country does not make clear provisions on the monopoly of price packages,administrative and judicial organs have fallen into a dilemma in practice and are unable to maintain a free and fair market order.This article introduces the meaning of monopoly behavior of price packages,the types of packages and the existing problems.From the perspective of economics and jurisprudence,the essential characteristics of the price package are analyzed.The price package is carried out from four aspects: whether the price package violates consumer choice,whether it constitutes a tie-in of communication services,whether it constitutes ultra-high pricing,and whether it constitutes price discrimination Illegal determination.After clarifying the identification of the price package,the price package was regulated by three aspects: the order to split the communication price package,the order to reduce ultra-high pricing,and the confiscation of illegal income and penalty.Finally,this article puts forward some suggestions on the current insufficient regulation of price package monopoly behaviors from the aspects of perfecting legislation,establishing a price review mechanism,and strengthening supervision and enforcement by antitrust enforcement agencies. |
