| Improving the professional security system for judges is one of the important contents of this round of judicial system reform.On April 23,2019,The Standing Committee of the National People’s Congress approved the amendment to the "Judges Law".The newly revised "Judges Law" absorbs the latest achievements of the reform of the judicial system,adds the content of guarantees for the performance of judges in the general rules,and separately sets up a chapter on "Professional security for judges" to increase the protection of judges.Protection still has a long way to go.The provisions on the protection of judges in the law are yet to be implemented,and special safeguard measures for judges need to further develop normative documents.This article is divided into five chapters.The first chapter,"Overview of Judges’ Occupational Security System," explains the specific content of judges’ occupational security and the historical evolution of the development of China’s judges’ occupational security system.Furthermore,it summarizes the significance of studying the professional security system of judges,and paves the way for the subsequent research.The second chapter is "Research on the Theoretical Logic of Judges’ Career Guarantee in China".The study of any institutional problem must have its theoretical background.This chapter attempts to analyze and explain the theoretical logic of the professional security system of judges starting from the particularity of the profession of judges and the latest judicial reform.It is pointed out that the judicial responsibility system and the professional security of judges complement each other and coordinate with each other;the integrity of the judge hierarchy also plays an indispensable role in promoting the professional security system of judges.During the rapid progress of the post system reform,the professional security of judges has not been followed up in time.Although it is effective in the short term,it will inevitably adversely affect the entire judicial justice in the long run.Therefore,the professional security of judges must be resolved during the post system reform Key question.Therefore,the occupationalsecurity of judges is a key issue that must be resolved during the reform of the post system.The third chapter is "Analysis of the Status Quo and Reasons of the Professional Security System for Judges in China".This chapter is based on a comparative analysis of the new revision of the "Judges Law" in China and the system before the amendment.The content of security is analyzed,and finally,the problems and reasons of the professional security system of judges in China are discussed in combination with the actual situation.The fourth chapter is "Review and Enlightenment of Foreign Judges ’Occupational Security System".This chapter briefly introduces the current status of foreign judges’ occupational security system,compares it with the current state of China’s system,and then summarizes the excellent experience for reference.Laying the foundation for feasibility recommendations in the next chapter.The last chapter is "Suggestions for Further Improving Chinese Judges’ Occupational Safety and Security System." This chapter combines the theoretical basis and research results of the previous four chapters,draws on foreign experience,and combines China’s national conditions.Provide rationalization and feasibility suggestions for further improving the professional security system of judges in China. |
