| At present,under the new normal of economy,the online trading market has been deeply integrated into all aspects of the operation of the national economy and people’s life,becoming a strong driving force for economic growth and an important way for entrepreneurship and innovation,which is of great practical significance to promote the structural reform of supply-side,expand consumption demand,and promote economic transformation and upgrading.With the rapid growth of the online market economy,the problem of the infringement to online consumers’ rights and interests has become increasingly prominent.If it is not contained as soon as possible,it will affect consumers’ confidence in the online market,and then the healthy development of the online economy.This paper mainly studies the situation of the damage of consumers’ rights and interests in the network transaction,aiming to sort out the current situation of the damage of consumers’ rights and interests in the online transactions,analyze the causes of the existing problems,and try to propose solutions.Firstly,references have been analyzed and basic concepts involved in the online transactions have been introduced.Based on the real cases encountered in daily work and cases published by the Internet,several types of consumer rights damage issues in online transactions have been sorted out,including the infringement of consumers’ rights to know,privacy,personal information and fair transaction,infringement on the use of contract format terms,the difficulty to determine the business credit information,the limitation of "Return of goods without reasons",the difficulty to guarantee the after-sales services and payment security,disputes of logistics and distribution,etc.Secondly,questionnaire surveys and analysis is used to analyze the reasons for the problems,including the sluggish legal system,weak supervision by the administrative department,weak consumer rights awareness,lack of remedy channels,and low tort costs for business operators.Finally,the countermeasures have been propesed to form a system to completely protect online consumers from infringement through the construction of policy,law,monitoring,supporting,administration and service system,which protects the legitimate rights and interests of online consumers,boosts consumer confidence,and promotes the sustainable and healthy development of the online economy. |
