| Engineering construction general contracting is a basic system in the field of construction project.Due to the high cost of construction,general contracting enterprises often set Pay-when-paid clause in subcontracting contract,in order to relieve the financial pressure.But the situation in real life there are complex and changeable,how to identify the owner has paid under different circumstances?This paper summarizes the problems existing in the achievement of the Paywhen-paid clause’s condition.The achievement of conditions can be divided into natural achievement and artificial achievement.This paper divides the problem of achievement of conditions into two types and analyzes them concretely.On the basis of case analysis,find out the solution to identify the achievement of Pay-when-paid clause’s congdition.At last,the author puts forward some suggestions on the achievement of Pay-when-paid clause’s condition from the practical point of view. |
