Study On International Law Protection Of Environmental Refugees

With the rise of sea level,land desertification and a series of environmental problems,a group of new refugees have emerged in the world,they are called "environmental refugees".However,due to the vague definition of environmental refugees,the international community does not recognize the status of environmental refugees.How to protect the legitimate rights and interests of such groups is worthy of our deep discussion.Based on the research and analysis of the existing international legal protection,it can be found that the environmental refugee problem can be included in the international safeguard measures for similar special groups(such as political refugees,immigrants,stateless persons and internally displaced persons).However,due to the specific objectives of protection and the limitations of tools,such attempts are difficult in theory and practice.Therefore,in today’s increasingly fierce economic and environmental changes,propose effective measures for environmental refugee safeguard to adapt to the development of the times,rather than blindly adhere to the past.In view of the international legal safeguard of environmental refugees,the current research is mainly from the theoretical point of view,but few scholars study this issue in the practical level.In the current fierce economic and environmental changes,the environmental refugee problem is becoming more and more serious.In view of its protection,we can move from theory to practice,summarize practical experience,and implement the problem.This paper mainly discusses from four aspects: first,the overview of environmental refugees,including the concept of discrimination and definition.The definition of refugees,the current situation of refugee safeguard,and the classification of refugees are analyzed.The origin and development of environmental refugees are introduced in detail.According to the definition,the views of relevant scholars on the concept of environmental refugees are given.The definition of environmental refugees is defined from four aspects,the causes of environmental refugees are introduced in detail,and the causes are divided Analysis is mainly from two aspects,such as natural and human factors.The concepts of environmental refugees,internally displaced persons,climate refugees,ecological refugees and environmental migrants are analyzed.Secondly,it analyzes the currentsituation of international protection of environmental refugees from two aspects: the basis of international law and the lack of protection.In view of the basis of international law,from the perspective of international refugee law,international environmental law and international human rights law,this paper analyzes whether the relevant provisions of these perspectives can provide legal basis for the protection of environmental refugees;from two different perspectives,it analyzes the existing difficulties in the safeguard of environmental refugees,so that the following paper can make targeted recommendations,such as the level of international legislation and implementation.The third is the legislative review of the international legal safeguard of environmental refugees,looking for problems from the international law level,finding corresponding ways from the practice of regional and national level,analyzing the practice of four regional refugee protection,analyzing the feasibility of environmental refugee protection from the regional perspective;analyzing from the domestic laws of various countries,illustrating the relevance of the United States,Japan and Germany to refugees Regulation,to explore the advantages of its provisions to apply to environmental refugees,so as to better protect the legitimate rights and interests of environmental refugees.Finally,in view of the deficiencies of international legal safeguard of environmental refugees and regional practice described above,relevant suggestions are put forward from the international legislative level and the implementation level;in the international legislative level,it is mainly discussed from the definition of its legal status,the establishment of bilateral or multilateral treaties and the establishment of special conventions for environmental refugees;in the implementation level,it is necessary to adhere to the principle of common but differentiated Strengthen international cooperation,establish environmental protection relief fund to discuss,and put forward relevant measures to deal with environmental refugees in China.
