The current climate problem has become a global issue that is highly valued by all countries in the world.Carbon emissions exceeding the atmospheric environment capacity have caused serious climate and environmental problems,posing a serious threat to the survival and development of human society,controlling and gradually reducing global carbon emissions has basically become the consensus of all countries in the world.Since the signing of the United Nations Framework Convention on Climate Change and the Kyoto Protocol to the United Nations Framework Convention on Climate Change,the carbon emission trading market,which is one of the most important means of global energy conservation and emission reduction,has gradually been established and developed in various countries.China’s carbon market construction began in 2012,and established carbon exchanges in seven provinces and cities such as Beijing,Shanghai,Hubei,and Guangdong to develop a regional carbon market system,which was rolled out nationwide at the end of 2017.At present,China is in the critical period of the nationwide unified carbon market construction with the power generation industry as a breakthrough.Under this background,it is of great significance to analyze the legal issues of China’s carbon market regulation.Based on mastering the classic thesis and the latest developments in the domestic and international research on carbon market,this paper comprehensively adopts the literature research method,the comparative research method and the historical research method to study the legal issues of China’s carbon market regulation.In terms of the structure and content of the text,this paper first tries to clarify the related concepts involved in the regulation of carbon market,and gives its own definitions based on the concepts of carbon emission rights,carbon emission trading and carbon market,and analyzes them.The value orientation of carbon market regulation;Secondly,this paper summarizes the current status of China’s carbon market operation,and summarizes the current status of China’s carbon market at the central and regional levels.It points out that there are existing carbon emission trading legislation in the carbon market regulation with low level of effectiveness and local carbon market regulations.The relevant standards are not uniform,and the national carbon market system has limited experience in legal practice.Thirdly,this paper focuses on the overall operation of the EU and US carbon markets,explores the legal system and regulatory mechanisms of the European and American carbon markets,and summarizes the experience of both the positive and negative aspects of the European and American carbon market regulation.Finally,based on the actual situation of China,this paper refers to the experience and lessons of carbon market construction in Europe and America,and proposes three legal proposals to improve China’s carbon market regulation:establish a basic legal system for carbon emission trading in the country,and form a national unified The carbon emission rights market regulation system and the strengthening of the national carbon emission rights market legal practice. |
