Study On Legal Risk Management Of HY Asset Management Company

In recent years,with the overall downward trend of the international market economy,the domestic GDP growth rate has also slowed down,and the domestic economic structure is facing adjustment.Under this background,the state puts forward the requirement of "removing production capacity,de-inventory and deleveraging" to the real economy.Under the market law of survival of the fittest,the enterprises with insufficient competitiveness appear operating difficulties or even go bankrupt,which leads to the outbreak of credit risk and the surge of non-performing assets.The rise of the non-performing rate of banks needs many professional non-performing asset management companies to help the banks to deal with these non-performing assets.The non-performing asset industry is an industry with very strong requirements for the professionalism of law and risk management,which requires asset management companies to have strong legal risk awareness and legal risk management ability.The paper starts from the legal risk management,choosing the legal risk management of Non-performing asset management companies as the researching object with the aim of discussing and solving the legal risk management issues faced with the Non-performing asset management companies.The author mainly starts with the present situation and existing problems of legal risk management of HY asset management company,through comparative study of the practical results of legal risk management at home and abroad,taking legal theory,management theory,risk management theory as the theoretical basis,combining the author’s many years of practical experience of legal risk management as a legal worker,using literature research method,case analysis and other research methods.This paper studies the present situation of legal risk management of HY non-performing asset management company and the reasons for its shortcomings,and then puts forward some suggestions and countermeasures for improving legal risk management according to the characteristics of the industry of non-performing asset management company,so as to help HY asset management company carry out the optimization design of legal risk management.The author analyzes the problems existing in the legal risk management of HY asset management company from the aspects of policies and regulations,capital operation,contract management,human resource management,corporate governance structure,and the reasons for these problems,such as the lack of legal risk awareness of the management,imperfect management system,and insufficient information construction.In view of these problems,in combination with the characteristics of nonperforming assets industry,the author puts forward suggestions for improvement of legal risk management from the aspects of formulating industry supporting laws and regulations,strengthening legal risk awareness,establishing legal advisory system,standardizing enterprise management system,etc.
