Research On The Criminal Procuratorial System Of Minors

In the socialist judicial system with Chinese characteristics,after years of theoretical and practical development and improvement,the juvenile criminal procuratorial system has come to the maturity of a new era.Procuratorial organs play an irreplaceable role in handling juvenile criminal cases.They must,in combination with judicial practice,summarize experience in a timely manner,face up to problems,actively improve the system of juvenile criminal procuratorial work for scientific reference,and constantly develop and improve the system of juvenile criminal procuratorial work.As one of the important contents of China’s judicial system and judicial reform,the juvenile procuratorial system is also changing with the change of the overall social environment,forming new features with the deepening of the reform,innovating in the center of the guard,and constantly improving in the development.The author takes the case of a county-level city-level procuratorate in northern Henan as a sample,analyzes and studies its characteristics and innovations,and starts from the concept of comprehensively deepening the reform of the judicial system at this stage.Analyze the solution to the problem.This article discusses the criminal prosecution system for minors in China from five aspects:The first part introduces the general situation of the juvenile criminal procuratorial system in China.This paper briefly expounds the basic concept,main features and development course of juvenile criminal procuratorial system.From the theory,the law and the judicial practice these three aspects to carry on the analysis introduction.The second part is an empirical analysis of the cases handled by the primary procuratorate of a county-level city(LZ city)in the north of henan province,and a summary of the characteristics and innovations of the juvenile procuratorial work in this hospital.The third part analyzes the problems existing in the criminal procuratorial work of minors in our country.From the perspective of the case handling situation of the procuratorate of LZ city,a sample of this paper,this paper analyzes the characteristics of the juvenile criminal procuratorial work,makes an in-depth analysis of the causes of the problems,and finds out the prominent existing problems in the juvenile criminal procuratorial system in China at the present stage.The fourth part elaborates the criminal prosecution system for minors in foreign countries and China’s Hong Kong,Macao and Taiwan regions.Through the analysis of the criminal prosecution system of minors in various countries of the world and China’s Hong Kong,Macao and Taiwan regions,it is found that its better experience and practices can provide a reference for the research of the criminal prosecution system of minors in China.The fifth part,put forward the suggestion.Admittedly,the system of juvenile criminal prosecution in China is not perfect,but it also means that there is still enough room for improvement.Promoting the improvement of the system of criminal prosecution is not only related to the procuratorial system of minors,but also to the development of the judicial system of minors in China.This paper tries to put forward some Suggestions from several key aspects to find out the reasonable way to perfect the juvenile criminal procuratorial system.
