Chinese Perspective On The International Investment Facilitation Agreement

The field of international investment has always lacked a multilateral,authoritative investment rule and no a global coordinating body.With the development of the economy,the international community has gradually realized that investment is the core of growth and sustainable development,and the call for establishing a multilateral investment framework in the investment field is growing.In recent years,investment facilitation has received much attention.This was influenced by the successful adoption of the WTO Trade Facilitation Agreement.Many countries have called for the establishment of a multilateral investment facilitation agreement under the WTO framework and submitted proposals about investment facilitation to the WTO.Many countries have taken the initiative to launch multi-party talks and exchanges on investment facilitation issues,and investment facilitation has become increasingly important on the global economic agenda.The proposal for an investment facilitation agreement is still at an exploratory stage and has yet to reach broad consensus.China is an active promoter of investment facilitation.Investment facilitation plays an important role in the implementation of China’s“One Belt,One Road”.China’s investment facilitation measures will also contribute to the future investment facilitation agreement.The purpose of this paper is to conduct a preliminary analysis of the international investment facilitation agreement,analyze the specific measures of investment facilitation that are widely discussed in the international community,and propose countermeasures against the difficulties faced by the international investment facilitation agreement from the perspective of China.This thesis can be divided into four parts:Chapter one is the analysis of the meaning of investment facilitation.There are close links and differences between investment convenience and investment promotion and investment facilitation.Investment facilitation is often linked to sustainable development.This chapter distinguishes these concepts.It analyzes the relationship between investment facilitation and sustainable development,and points out the way investment facilitation helps sustainable development.Chapter two is about the content of the investment facilitation agreement.Investment facilitation is an emerging issue,and the establishment of a multilateral investment facilitation agreement requires a lot of exploration and challenges.This chapter mainly summarizes the practice of investment facilitation in international organizations and countries including China,and analyzes the main contents of investment facilitation from the three dimensions of transparency,efficiency and investment promotion.Chapter three is the practical exploration of China’s investment facilitation.China actively promotes investment facilitation.On the one hand,it has adopted the free trade zone in China to simplify investment administration procedures.On the other hand,China has led the establishment of“Friends of Investment Facilitation”and submitted the“China Program”to the WTO for investment facilitation agreements,showing the style of a big country.This chapter analyzes the reasons for China’s investment facilitation and analyzes the specific measures for China’s investment facilitation.Chapter four is the dilemma and prospect of signing an international investment facilitation agreement.Many countries,including China and Brazil,have submitted investment facilitation proposals to the WTO,aiming to discuss investment facilitation under the WTO framework.This chapter first analyzes the investment facilitation under the WTO framework and discusses whether the WTO is the best place to discuss investment facilitation.Then it analyzes the dilemmas and challenges faced in the discussion of current investment facilitation issues.From the perspective of China,it proposes Corresponding countermeasures,and pointed out the direction of China’s efforts to promote investment facilitation in the future.
