The Legal Study On Investment Facilitation Of Shanghai Cooperation Organization

With the big background of economic globalization,regional cooperation is increasing,and the attention to trade and investment facilitation is becoming more and more.Shanghai cooperation organization(SCO)has experienced more than ten years of development,compared with its inception,the convenience degree has been improved obviously.SCO has played a great role in promoting regional integration process.The scope of investment cooperation between member states expands unceasingly,to deepen regional economic cooperation.This article aims to review the establishment and development of the Shanghai cooperation organization,pay close attention to its present situation,and propose several legal issues in the process of investment facilitation,by analyzing the legal issues,to put forward rational suggestions and measures for its development of investment facilitation in the future.This article is divided into five chapters.The first chapter is an overview of the legal basis and the defects of SCO investment facilitation.The second to the fourth chapter shows the analysis of the current legal problems while the fifth chapter provides the solutions to the problems and the suggestions on how to improve SCO investment facilitation in the future.The first chapter mainly introduces the conception of SCO and the theory of investment facilitation,after which it analyzes the performance of SCO investment facilitation combining with the sense and the features of it.The second chapter makes a conclusion that the legal sources of SCO are mostly soft law by listing the sources out and makes further analysis on how soft laws impede the procession of investment facilitation as its legal source.The third chapter analyzes the investment access barriers to the member states during putting the investment facilitation forward from the perspective of problems existing in investment industries,investment conditions and investment approval.The fourth chapter analyzes the necessity of building an SCO investment dispute settlement mechanism to make the urgent need of it clear.The last chapter analyzes the problems,provides the solutions and then gives advice on future improvement of SCO investment facilitation,including refining the theories,strengthening the building of SCO legislation,optimizing investment access and building a dispute settlement mechanism for SCO investment facilitation.
