| How to define ’the Philosophy of Law’?Different thinkers among history of this field give different answers.The definition of the Philosophy of Law has been changing along with the process of history is moving ahead.During this period,different schools of Philosophy of Law had formulated their own definition.On the basis of criticizing and revolutionary innovating predecessors’ theories,Marx established his own system.Marx’s Philosophy of Law overthrew the dominant theory system which was featured by idealism,from the aspect of historical materialism position and economic research perspective,Marx established the theory system of Philosophy of Law.This article holds the theme of the formation and development Marx’s theory of Philosophy of Law,take the works of Marx in different periods as clues,to summarize and comb the Marx’s Philosophy of Law from the following three parts:First chapter,starting from the background of Marx’s Philosophy of Law,mainly analyzes the era background and the origin theory of the western thinkers like Thomas Hobbes,John Locke,Baron de Montesquieu,Jean-Jacques Rousseau,Immanuel Kant and Hegel.Second chapter,Marx’s Philosophy of Law is divided into four main stages,mainly combs the development and evolution of Marx’s Philosophy of Law in different stages.On the basis of criticizing and inheriting of Philosophy of Law of Kant and Hegel,Marx formed his own distinctive system of Philosophy of Law,and further developed this system.The third chapter,which expounds the historic contribution and unique value of Marx’s Philosophy of Law.It mainly starts from Marx’s viewpoint of the essence of law,the relationship between the freedom and law and the description among the civil society and the law,summarizing the transcendence and innovation of Marx’s Philosophy of Law compared to the predecessors’.Therefore,this article tries to explore the core of Marx’s Philosophy of Law through combing the theory of different periods works of Marx and summarizing the theory which hided in these works,to reveal historical transformation and revolutionary significance of Marx’s Philosophy of Law compared to the previous relative theories of Philosophy of Law of thinkers,and to deeply discuss the luminous and new points of Marx’s Philosophy of Law,and finally to promote the wider recognition of Marx’s Philosophy of Law. |
