The report is an analytical study based on a translation practice.It summarizes the typical translation problems seen in the practice and attempts to analyze them from the perspective of functions,so as to find out methods for translating Chinese judgments into English.With the guidance of text typology and reference on the bipartite classification of legal texts,the source text(ST)was classified into three categories according to functions(descriptive,prescriptive or descriptive and prescriptive)and was discussed with typical examples selected from three aspects(lexical,syntactical and textual levels).To be specific,at the lexical level,the translations of common words with uncommon meanings,legal terms,and terms of art in other fields were discussed;at the syntactical levels,translations of zero-subject structures,serial verbs structures,and pivotal structures were studied;at the textual level,the use of conjunctions and reference were discussed.Through analysis,tentative translation methods were proposed: For parts with prescriptive function,legal equivalence should be prioritized;for parts with descriptive function,legal intents and accuracy shall be stressed;and for parts with descriptive and prescriptive functions,all of the said factors should be taken into consideration.The report has the following findings.On one hand,it summarizes through translation practice the different functions of different parts in the source text and provides tentative methods of translating Chinese judgment for other legal translators.On the other hand,it also sheds light on research orientations for future studies.
