A Practice Report On The E-C Translation Of Intellectual Property:Valuation,Exploitation,and Infringement Damages(Excerpts)

With the further implementation of the National Intellectual Property Strategy and the continuous improvement of the level of opening up to the world,China is attaching increasing importance to foreign intellectual property exchanges.Britain and the U.S.have accumulated rich experience in the field of intellectual property,so the research on translation of intellectual property texts can provide basic reference materials for relevant legal institutions and researchers in China,thus promoting the progress of China’s intellectual property legal system and building an innovative country.This report is based on the translation practice of Intellectual Property: Valuation,Exploitation,and Infringement Damages published in 2018 by the United States,using Newmark’s semantic and communicative translation theory as a guide,selects typical cases from the original text and analyzes them by adopting case study method to summarize corresponding solutions to common difficulties in the translation of intellectual property texts.This report firstly introduced the purpose,significance,research methods and theoretical guidance of this report on translation practice.Secondly,it expounded the translation task and the translation practice process.The author summarized the semantic and communicative translation theory and its application in the translation practice.According to the theory,the author found out the translating difficulties in the source text,such as professional terms,fuzzy words,passive sentences,long difficult complex sentence of translation process as well as the logical construction and discourse style of the text from the lexical,syntactic and textual levels.The author has made a detailed analysis of these translation difficulties,and thus summed up the corresponding specific translation strategies and methods,such as the application of translation techniques in the process of translation practice,such as the addition of translation,annotation,the combination of literal and free translation,split method and voice conversion method,to retain the formal format and rigorous stylistic style of the source text.By summarizing the methods and techniques of translating source texts into Chinese,this report aims to provide a useful reference for the research and practice of translation of intellectual property texts.
