The father-son relationship refers to the sum of the rights and obligations between parents and children.The father-son relationship is at the core of the entire family relationship and is an important tool for maintaining family harmony and stable governance.In the process of the establishment and continuous improvement of ancient Chinese laws,the norms of the relationship between father and son were directly incorporated into the legal system.Due to the differences in many aspects,the Qin and Han laws divide the father-son relationship into the father-son relationship of natural consanguinity and the father-son relationship of fictitious consanguinity.This article takes the relationship between father and son in the Qin and Han dynasties as the research object,combining handed down documents with unearthed materials,and discusses several related issues about the relationship between father and son.The chapter arrangement and main content of the full text are as follows:The first chapter is the definition of the relationship between father and son in the laws of Qin and Han dynasties.This chapter mainly divides the relationship between father and son into biological father and son,"stepfather and son",and "false father and son" based on whether they are related by blood.The biological father and son refer to the direct blood relationship between parents and children;"stepfather" and "stepson" refer to a non-blood relationship created by the mother remarrying and remarrying,and the father remarrying;"false father" and "false son" have opposite meanings Complicated,it has gone through a process of change: Before Wu Yin in December 26 th of the Qin Wangzheng,the meaning of "false father" refers to the stepfather."Fake son" in Qin and the early Han Dynasty refers to stepson;in the Eastern Han Dynasty,another term was added,namely adopted son.The second chapter is about the rights and obligations of father and son in the laws of Qin and Han dynasties.According to the different laws and regulations of the Qin and Han dynasties,it is divided into the legal norms of the relationship between the biological father and son and the non biological father and son.The legal norms of the relationship between father and son include the rights and obligations between father and son,and whether the performance of these rights and obligations will be rewarded or punished.At the same time,the legal norms of the biological father and son and the non-biological father and son are compared to analyze the similarities and differences and their reasons.The three chapter is the process,significance and influence of the legalization of the relationship between father and son in Qin and Han Dynasties.In ancient China,the relationship between father and son was stipulated in primitive society as a primitive custom;as a kind of ritual in the Xia,Shang and Zhou dynasties;it took shape during the Spring,Autumn and Warring States period;and it was basically established as a legal system in the Qin and Han dynasties.The legalization of the father-son relationship has a certain historical significance in maintaining family stability and unity,and social stability,and has a profound impact on the legislation of later generations.
