Introduction to the Law of Contract is a book with a systematic introduction to British contract law.The source text in this translation report is excerpted from chapter five to seven of this book:intention to create legal relations&certainty,the terms of a contract and exemption clauses.According to the text type in Newmark’s translation theory,the source text presents its typical characteristics of the informative text.In order to render British contract law accessible to Chinese readers,the translator mainly employs the communicative translation strategy to solve problems at lexical and syntactic level.At lexical level,the translator adopts the translation techniques of amplification,omission,conversion as well as affirmation and negation to deal with the linguistic phenomena of numerous terms,ambiguity and so on in the source text;at syntactic level,she employs the translation technique of restructuring to focus on processing of the subject in the source text and choice of the subject in the target text in terms of English sentences with inanimate subjects,and the translation technique of paraphrasing rather than directly translating the passive voice into the sentence with the character“被”in terms of passive sentences.Through this translation practice,we may conclude that Newmark’s translation theory can function as an effective and efficient guidance to overcome difficulties encountered in translation of legal texts,so that the translation can accurately reproduce the information of the source text and conform to the norms of the target text in a creative way.
