| The source text of this translation practice is excerpted from chapter II of the legal monograph Studies on the Adjustment Mode of the Intermediate Domain of Contract Law and Tort Law,which is a project funded by National Social Science Foundation.The chapter II mainly discusses pre-contractual liability and the system of civil liability.In this chapter,the author,Zhang Jiayong clarifies pre-contractual liability,liability for breach of contract and tortious liability,and points out the relationship between the misconduct in the pre-contractual stage and tortious liability.According to text type theory proposed by Newmark,the source text belongs to informative texts,and the communicative translation method should be adopted correspondently.Under the guidance of this theory,the translator adopts a variety of translation techniques,such as addition,omission and division.Then the translator solves the problems in the translation process such as the translation of legal terms,common words with unique legal meanings and technical terms involving lexical gap,as well as the translation of non-subject sentences and long sentences.In the translation process,the translator always pays attention to the realization of communicative effect.Through this translation practice,the translator has observed that legal translation should adhere to the principles of accuracy,consistency and conciseness,so as to ensure the rigorousness of legal language.This translation practice aims not only to introduce the studies of the intermediate domain of contract law and tort law to foreign legal researchers,lawyers and professionals,but also to provide a reference for the translation of legal monograph.In addition,the translator hopes that through this translation practice,the Chinese legal culture can be better introduced to other countries in international exchange. |
