Research On The Current Situation And Countermeasures Of New Plant Varieties Protection In Guangxi

Crop seed industry is a national strategic and basic core industry,which is the basis for promoting long-term stable development of agriculture and ensuring national food security.To develop modern seed industry,seed intellectual property right is the key and an important support for the construction of modern seed industry.Guangxi is a large agricultural province,under the development strategy of modern seed industry,it is of great significance to establish a perfect protection system and working system for new varieties of plants,and to improve the ability of creation,application,protection and management of new varieties of plants.In this paper,using literature analysis,qualitative analysis,study on protection of new plant varieties in Guangxi,firstly analyzes the present situation of new plant varieties protection in Guangxi.It is concluded that the new plant variety right system in Guangxi has been gradually improved,the judicial supervision has been strengthened,the administrative law enforcement methods have been standardized,the technical support system has been formed,and the protection of new plant varieties has achieved remarkable results.Second,summed up the new plant varieties protection in Guangxi from the present situation of all needs to improve the quality and quantity at present,the agricultural application of rights to new plant varieties,authorization,unreasonable varieties structure,varieties of maintenance and the use of a lack of enthusiasm,the standardization,the commercial breeding systems and mechanisms have not been established,the principal position of enterprises breeding is not clear,the system construction and supervision services are insufficient five major problems,and carry on the reason analysis.Thirdly,the author analyzes two typical infringement cases of new varieties of plants in China,and finds out that Guangxi should further strengthen the protection of new varieties of plants,and that cultivators should improve their awareness of safeguarding their rights,have the courage to protect their rights,and provide professional legal advice and services.Finally,in view of the problems existing in the protection of new plant varieties in Guangxi,this paper proposes to strengthen the protection of new plant varieties in Guangxi from five aspects.The five aspects: strengthen the seed industry science and technology innovation,and promote the development of maize seed breeding of high quality,optimize the structure of application,authorization,varieties of new plant varieties,strengthening the protection of new plant varieties of propaganda and training and guidance,perfecting the system construction,strengthen the protection of new plant varieties third-party services,actively explore commercialized breeding new mechanism,we will increase support for kinds of enterprises.
