| With the improvement of people’s quality of life,the number of motor vehicles is increasing day by day.In 2020,the number of motor vehicles in the country will be 372 million,an increase of 6.9% over 2018.Mobile source pollution has become a major contributor to air pollution in large and medium-sized cities.In addition,my country’s "14th Five-Year Plan" has formulated new goals and requirements for air pollution prevention and control,and also put forward the goal of peaking carbon emissions.As a major contributor to air pollution and mobile source pollution with high carbon emissions,it is the key to achieving air pollution prevention and carbon emission reduction goals.my country’s current mobile source pollution control model has many defects,such as rigid government management,passive law-abiding enterprises and negative treatment of mobile source pollution control responsibility due to their inferiority..Incorporating the government,enterprises,and the public into the "multiple co-governance" model and forming a legal mechanism will be an effective way to solve the problem of mobile source pollution control.By redistributing the power of the government to mobilize the enthusiasm of other governance subjects such as enterprises and the public,give full play to the active role of each subject in the control of mobile source pollution,improve the efficiency of mobile source pollution control,and reduce the cost of law enforcement.The multi-party governance energy will be twisted into a force to solve the problem of mobile source pollution control together.This paper focuses on the construction of mobile source pollution control theory and legal mechanism,summarizes the difficulties of mobile source pollution control in my country,and analyzes the current situation and control measures of mobile source pollution in Beijing,Xi’an,and Hangzhou,which are typical cities in China.On the basis of the above analysis,with the idea of "operating mechanism-responsibility sharing",the drawbacks of the traditional management mode of mobile source pollution in my country are discussed in depth,and the "multiple co-governance" mode is proposed.This model can mobilize the enthusiasm of all parties for environmental pollution control,so that mobile source pollution control can achieve better results,and a stable "multiple co-governance" can form a long-term mechanism to make mobile source pollution control a normal state.Corresponding institutional rules outside the territory also provide experience for my country to establish a legal system of multiple co-governance of mobile source pollution.The "full life cycle" management system of the United States has made extremely detailed regulations from fuel,production and sales of mobile sources to the end of incentives to eliminate vehicles with excessive emissions,which points out the governance logic for the construction of a multi-component co-governance system for mobile source pollution.The UK’s public participation system and Japan’s voluntary environmental agreement provide practical experience for mobilizing the initiative of all parties and enhancing the internal motivation of all parties to participate in governance.Finally,in view of the shortcomings of China’s traditional mobile source pollution control model,this paper proposes the mechanism structure and realization path of China’s mobile source pollution "multiple co-governance" : At the government level,it is necessary to promote and improve the construction of the legal and policy system for the multi-party co-governance of mobile source pollution.Clarify the division of powers and responsibilities among departments,strengthen the leading role of the government in multi-level co-governance,and provide a good and orderly development environment with the rule of law for co-governance;at the level of the main body of the enterprise,through the government-led establishment and establishment of mobile source production and sales enterprises and third parties Detect the incentive mechanism of enterprises and provide assistance for enterprise pollution control,clarify the responsibility of enterprises for mobile source pollution control under the leadership of the government and the participation of the public,and improve the enthusiasm and participation of the main body of enterprises in multi-governance;at the level of public participation in governance,improve and improve the public participation mechanism,focus on cultivating and supporting grass-roots environmental protection organizations and community organizations,so that the public and social organizations can actively assume the responsibility of supervision and governance of the government and enterprises,and fully self-governance. |
