In recent years,with the deepening of national ecological civilization construction,a new wave of environmental protection has been set off all over the country.In order to deal with various types of environmental disputes emerging in the new era and explore the specialized trial road of environmental cases,various regions have tried to build environmental resources trial court.The establishment of Dongting Lake Environmental Resources court is a beneficial attempt to explore the specialization of environmental justice in Dongting Lake.In the trial process of the case,the court implements the idea of ecological civilization and guides the judicial trial with the concept of green development.In the process of the implementation of the case,try to "replant","proliferation and release" and other ways to explore the restorative environmental justice.In addition,the court made great efforts to build a multi-party cooperation mechanism,set up the judicial protection base of East Dongting Lake with Yueyang intermediate people’s court,and set up the ecological restoration forest base with local environmental protection department,actively exploring "jointly grasping the large-scale protection,not large-scale development".At present,the specialization degree of environmental justice in Dongting Lake still needs to be improved,the setting of environmental judicial organs is unreasonable,and the layout of judicial organs and the allocation of judicial resources are difficult to meet the needs of centralized trial.In the process of judicial trial,litigation cost system,evidence system and public interest litigation system need to be improved.In addition,the specialization of the environmental trial team is limited,which can not meet the needs of the case trial across the "three cities and one lake".In order to solve the problems existing in the process of environmental judicial specialization of Dongting Lake.First of all,we should reconstruct the layout of judicial organs,gradually establish environmental courts,provide convenience for the masses to participate in environmental litigation,and further standardize the cross regional centralized jurisdiction,so as to promote the scientization of environmental judicial organs.Secondly,we should gradually establish the litigation cost sharing mechanism,reasonably refine the litigation evidence system,improve the environmental public interest litigation system,and promote the systematization of the environmental judicial system.Finally,in order to realize the specialization of environmental judicial personnel,we can take many measures to improve the judge’s trial level,expand the environmental trial team,set up the expert committee,and improve the people’s jury system,so as to provide intellectual support for the construction of environmental judicial specialization of Dongting Lake in the new era.
