Although the stages,speeds,and industrial structures of development are not thesame,in various countries and regions around the world,soil pollution among environmental pollution has always been a topic that should or has been paid much attention to.In our country,due to the deepening of the economic recovery and the continuous impact of industrial development after the founding of the People’s Republic of my country,the environment and resources have not received the attention and treatment that matched the economy.As the country pays more and more attention to the protection of environmental resources,the people’s awareness of environmental protection and sustainable development continues to increase.Some environmental issues such as water pollution and air pollution have been brought into the legislative vision by legislators and corresponding legal documents have been issued to regulate them.As one of the important environmental foundations,it has not been treated uniformly and standardized.For a long period of time in the past,relevant laws and regulations for soil pollution control were scattered among the provisions of some regulatory documents,government regulations or administrative regulations,and did not rise to the legislation of the National People’s Congress.The Soil Pollution Prevention and Control Law of the People’s Republic of China(hereinafter referred to as the Soil Pollution Prevention and Control Law),which came into effect at the beginning of 2019,filled the legal gap at this level.Although a crucial step has been taken in legislation,it is clear that this does not mean that the soil pollution problem has been fundamentally solved.Compared with other legal disciplines,administrative law more prominently shows the response and governance of social issues from the dimension of the superstructure.Therefore,from the perspective of administrative law,the construction of administrative regulations for soil pollution prevention and control can not only solve Provide suggestions on soil pollution issues,and can also realize the practical value of administrative law,so that it can be implemented on the ground.In summary,this article will make full use of the methods and ideas of government regulation theory to explore the administrative regulation methods of soil pollution from the level of administrative law,and make a more comprehensive summary of this problem.First of all,this article will make a detailed combing of the changes and current situation of soil pollution,and make a theoretical explanation of administrative regulations,so as to dredge the historical development process of my country’s administrative regulations on soil pollution.Secondly,it distinguishes the traditional administrative regulation methods from the research methods of administrative law,and points out the problems in the soil pollution control under the traditional administrative regulation model,including single regulation methods,excessive reliance on command-and-control methods,and unified regulation subjects.In addition,it explores advanced practices in the administrative regulation of soil pollution outside the territory,and based on this,extracts some useful experiences that are suitable for our country.Finally,on the basis of the foregoing,adhere to the basic principles of the administrative law,and put forward suggestions for optimization of my country’s soil pollution administrative regulations.
