| Since the 19th National Congress,the central government has pushed the construction of ecological civilization to a new height and achieved remarkable results.The 14thFive-Year Plan period also outlines new concepts and plans for the harmonious coexistence of man and nature for the construction of ecology and civilization.Although a series of policy documents and laws and regulations have been introduced in China,there is still no relatively perfect system of compensation for ecological and environmental damages,and there are many problems in the operation of the system.As the breakthrough point and foothold to break the vicious circle of"enterprises pollute the environment,people suffer from the environmental deterioration,governments pay the bill",it is of great significance to carry out the judicial concept that lawbreakers must be prosecuted and law enforcement must be strictly enforced,and to consider the theoretical improvement and realistic path of the damage compensation system.By increasing the cost of ecological pollution,building a comprehensive prevention,motivating enterprises to comply with environmental protection regulations and increasing environmental protection investment,guaranteeing the restoration of the ecological environment through a variety of damage compensation relief mechanisms,can effectively achieve the purpose of protecting the ecological environment.This paper first summarizes the operation problem of system by clarifying and analysing the basic concept,and draws reference from the evaluation of the systems of foreign countries,and then discusses a better solution from improving legislation and the mechanism for handling environmental damage compensation disputes,strengthening the public participation,improving the identification and assessment for the compensation of eco-environmental destruction and establishing the compensation fund and insurancean of eco-environmental destruction.The purpose of this study is to explore the ways to improve the ecological damage compensation system and to promote environmental protection. |
