International Comparative Research On Environmental Liability Insurance System

The social modernization process has accelerated significantly since China’s reform and opening up.When we are proud of the great achievement,we should pay more attention to the increasing environmental pollution problems.China has been one of the most severely polluted countries in the world now.Environmental pollution has seriously affected the sustainable development of china.Environmental liability insurance(ELI)is one of the most effective mechanisms to deal with the risk of environmental pollution and ecological damage.ELI may transfer risks to ensure the compensation of victims,and avoid the bankruptcy of the responsible.China has carried out the pilot work of environmental liability insurance since the 1990 s,but the result isn’t as expected.It is necessary to conduct an international comparative study on ELI.In this dissertation,by studying on the legal environment,insurance model,coverage,limitation of claims,exclusions,obligation of notification,and insurance amount of environmental liability insurance,the author analyzes the characteristics of environmental liability insurance in United States,Germany,Japan,and China to summarize their experience.And by summarizing their experience,the author puts forward several constructive advices for improving the construction of china’s environmental liability insurance.
