Research On Soil Pollution Prevention And Control Fund System

The deterioration of soil pollution affects human survival.The period of soil pollution control is long,the treatment measures are complex,the amount of funds needed is large,and the soil pollution prevention and control work in various places is not obvious because of the shortage of funds.From the system design of soil pollution control,most countries in the world have formulated laws and regulations for soil pollution,and the introduction of the soil pollution prevention and control law also provides the top-level system design for soil pollution prevention and control soil pollution prevention and control.However,the principle of soil pollution prevention and control fund system is too strict.It is easy to cause the system to become mere formality and can not play a real effect.Therefore,it is of positive significance to refine the provisions of the legislation on the soil prevention and control fund and to formulate the soil pollution prevention and control fund system in accordance with the national conditions of our country.From the extraterritorial experience of soil pollution control,many countries and regions have introduced public welfare fund system for soil pollution prevention and control,such as the super fund system in the United States and the compensation system for public hazards in Japan.Based on the theories of public trust,sustainable development and the socialization of tort liability,this study summarizes and summarizes the research on soil pollution prevention fund system at home and abroad by using literature analysis method.This paper investigates the operation of soil pollution prevention and control fund and its practical basis,and points out the difficulties in constructing and perfecting the soil pollution prevention and control fund system in China from the aspects of top-level legal system design,fund supervision and management organization,fund application subject qualification,fund use supervision,soil control effect supervision,etc.By using comparative analysis method,the relevant provisions of the Superfund Law of the United States,the soil pollution remediation fund system in Japan,the Dutch SUBAT fund system and the soil and groundwater remediation fund system in Taiwan are investigated,and the experience of perfecting the fund system in China is put forward from the aspects of legislation,fund raising channels,use conditions and management system.Finally,from the aspects of improving the establishment of relevant funds for prevention and control of soil pollution,expanding the channels of fund sources,standardizing the scope involved in the fund,clarifying the daily management system of the fund and the external supervision mechanism for the use of the fund for prevention and control of soil pollution,this paper puts forward somecountermeasures and suggestions of soil pollution prevention and control fund in China are put forward.
