On The Optimization Path Of Environmental Trial Mode In China

The ecological environment is closely related to human beings,is the basis of human survival and development,and is also a dynamic and balanced organic whole.In today’s society with increasingly severe ecological environment situation,in order to promote the harmonious development of human and nature and make people live in a comfortable,clean and healthy environment,we need to explore a series of practical and effective methods to protect the ecological environment,so as to solve the growing environmental problems and realize the sustainable development of the ecological environment.With the growing environmental problems,with the unremitting efforts of the relevant departments and academic circles in China,environmental laws are gradually improving,and environmental justice is also advancing hand in hand.In order to promote the specialization of environmental trial,all walks of life began to explore the mode of environmental trial.So far,many regions have carried out a series of innovative exploration of environmental trial mode for local environmental problems,accumulated a lot of practical experience,and achieved certain social and judicial effects.At present,the practice mode of environmental trial in China is quite different,mainly divided into "single" mode,"two trials in one" mode,"three trials in one" mode and "four trials in one" mode.As a result of this "bottom-up" specialized innovation of environmental trial,the mode of environmental trial lacks national uniform,clear and detailed provisions,and the traditional mode of trial can not meet the needs of environmental trial,so there are many problems to be solved in the actual operation.Firstly,this paper defines the concepts of environmental trial specialization and environmental trial mode,and then analyzes the relationship between them.On the basis of clarifying the relevant concepts and relations,this paper studies and summarizes the problems in reality from the practice of environmental trial mode in all parts of China.By summing up the mode of environmental trial in China,we can find that the existing mode of environmental trial has the following defects and deficiencies,that is,the mode of environmental trial in China is not unified,the mode of environmental trial does not work well,and the mode of environmental trial lacks effective trial rules.In the long run,it is not conducive to the further specialization of environmental trial,the protection of ecological environment and the development of ecological civilization.Therefore,in view of the above problems,combined with the existing practical experience of environmental trial mode in China and the matureexperience of foreign environmental trial,the optimization path of environmental trial mode is proposed,which is to build a national unified specialized environmental trial mode,improve the supporting measures of environmental trial mode,and establish specialized trial rules of environmental cases.The idea is to turn environmental trial into a powerful weapon to maintain the ecological environment.
