| This study was undertaken to determine if the current practices in assessment of limited-English proficient (LEP) students are being conducted according to the laws set by IDEA and also Diana v. State Board of Education (C-70-37 RFP, N.D. Cal., 1970). Interviews were conducted with psychologists from five school districts throughout the southern California area. Results were analyzed using qualitative methodology and two issues emerged: invalid testing practices and resistance. Under these issues six different themes were explored: lack of validity and reliability, test-item bias, no response, lack of cooperation, defensiveness, and lack of knowledge. The researcher concludes that the laws designed to assure Non-Discriminatory Evaluation are being consistently violated. |
