| The rise of the sharing economy has profoundly changed the consumption and production in the market,especially in recent years.The sharing economy has been frequently mentioned by policies,and it has been regarded as the next economic growth point.However,the chaos in the sharing economy industry tests the regulatory system and poses new challenges to the governance capabilities,requiring a better regulatory system.Based on property rights theory,this paper builds a framework for the interpretation of government regulation and sharing economy.That administrative power adjusts property rights is the essence of government regulation.Also,the sharing economy is a revolution in property rights,based on sharing property use rights.This paper argues that regulatory dilemma of the sharing economy is the conflict between emerging economic patterns and traditional government regulations.This paper analyzed the development of the sharing economy and summarized the current status of regulatory system,which is launched in three parts: the development of the sharing economy,the conflicts of government regulation,and the solution paths of regulatory dilemma.Firstly,the changes in the realization of property rights and the process of alienation in the sharing economy destroyed property rights.The essential attribute of the sharing economy is the sharing of the right to use property,which is a new way of property right allocation.However,the deviation of property rights during the development and prosperity of the sharing economy led to a series of property problems.Then,since the government regulation system of the sharing economy has not changed,the conflicts between the traditional regulatory system and the new property rights system of the sharing economy are summarized.The analysis of the policy text of the sharing economy proves that the current regulatory system of the sharing economy is still the traditional regulation model,and it conflicts with the property rights arrangement of sharing economy,in terms of regulatory objectives,subjects,implementation and objects.The sharing economy regulation problem is an inherent conflict between the traditional regulation model and new arrangement of property rights.The sharing economy is constrained by the traditional regulatory system,which has not been integrated with the sharing economy.It can neither solve the market failure caused by the development of the sharing economy,but also eventually lead to the failure of government regulations.Finally,the regulatory dilemma is attributed to the longterm binary opposition between the government and the market.To solve the dilemma of sharing economy regulation,it is necessary to build a new regulation system from three paths: Create a new market for the sharing economy and guide the behavior of enterprises and consumers.Adjust the traditional government regulatory system to the new property rights structure.Build a new cooperative relationship between the government and market to solve the contradiction between the new economic and traditional regulations. |
