Analysis And Research On Government Procurement Review Information Disclosure

In China,the scope of government procurement is gradually expanded,and the scale of procurement has increased significantly than that of fiscal expenditure and GDP growth rate.Chinese government procurement not only plays a more and more important role in society and economy,but also carries more and more social expectations.Review is the most important link in the chain of government procurement.However,with the practice of a series of laws and regulations,there are many problems in the information disclosure of the review,so it is very important and urgent to sort out and solve these problems.This paper focuses on the information disclosure of the review,collates and compares the relevant theories and laws and regulations of government procurement and the disclosure of government procurement information,and takes the case "A company complaint rejected" as the starting point,combining with the concrete analysis of the case.This paper studies the necessity,significance and exception of government procurement review information disclosure.It is hoped that from the analysis and research we can get some thoughts and enlightenments,so as to put forward the corresponding solutions,and hope that through this article we can make suggestions for better handling of the different understandings and conflicts between the three parties.The thesis consists of four parts:The first part is the introduction.In the beginning,the author's analysis and research purpose,analysis and research significance,research summarization,research methods and innovations are stated,and the author's ideas and methods are put forward.The second part is the relevant theoretical basis,the author enumerates the different theories and concept of government procurement,and indicates the viewpoint that the author agrees with.Then the characteristics and main principles of government procurement and the value objectives of government procurement law are summarized in order to correctly understand and scientifically study the publicity of government procurement review information.The third part,the case analysis of the information disclosure of government procurement review.This part analyzes and concludes the causes of these problems in the legislation and practice of the information disclosure of government procurement review.On the basis of the necessity and importance of the information disclosure of government procurement review,this paper emphasizes the necessity of public review information disclosure from the perspective of the public attributes of government procurement,the principal-agent relationship,and the unequal position between the purchaser and the supplier.This paper expounds the importance of review information disclosure.The relevant subjects of the publicity of the review information are determined,define the concept and scope of government procurement suppliers.and realize that the obligations and responsibilities of the relevant subjects to the review of information disclosure can protect the rights of suppliers furthest.This paper discusses the exception of information disclosure in government procurement.First of all,we should grasp the exception principle of the disclosure of review information from the macro aspect,and the state secrets in the review information are absolutely undisclosed,while trade secrets and personal information belong to the information of relative exemption from disclosure.Then,their characteristics and judgment criteria are expounded,and some methods that can be used in practice are put forward.The fourth part is the reflection and enlightenment of this case.This paper mainly expounds the author's different views on the results of case processing after analyzing and studying the previous part of the article,and humble opinion on the perfection of the disclosure of government procurement review information at the legal level.In this paper,throw out some suggestions: standardizing activities of purchasers in practice,standardization construction of information disclosure platform,review of information disclosure,establishment of social review and strict assessment and accountability mechanism,and so on.
