Research On The Relationship Between Patent Maintenance And Entity Size Based On USPTO Data

In the Thirteenth Five-Year Plan for National Intellectual Property Protection and Ut ilization,improving the quality and efficiency of intellectual property rights is an importa nt task to be deployed.While maintaining the growth of patents,it is required to further improve the quality of patents,increase steadily,adjust the structure and promote transfo rmation.Patent maintenance refers to the process in which the patentee pays the prescrib ed amount of maintenance fee to the patent administrative department in the legal statuto ry protection period to make the patent continue to be valid.After patent research and de velopment,application and authorization,patent maintenance is the key period for a pate nt to truly play its economic value.The longer a patent can be maintained,the greater ec onomic benefits it can bring to enterprises.As a patent powerhouse,the United States has a special feature for the maintenance of patent maintenance fees.According to the provisions of the US Patent and Trademar k Office,in the maintenance fee charging rules,the entity types are divided into three ty pes: large,small,and micro,and different types of patent maintenance fees are charged.The difference in the maintenance behavior of these three different types of physical pate nts also represents the quality of their innovation and development.In view of this differ ent classification of the rights of the rights holders,based on the patent payment databas e and basic patent information provided by the US Patent and Trademark Office,from th e two different legal states of the patent-invalid patents and valid patents,The quantitat ive characteristics of patents held by entities of scale,such as total holdings,per capita h oldings,distribution of rights holders,and distribution of technical areas,are analyzed.A fter that,the impact of the patent life and the effective patent maintenance time on the s cale of the enterprise will be further analyzed.The study found that from the quantitative characteristics,large entities have absolut e advantages in patent holdings,and the per capita patent holdings are far higher than th e other two types.There is no big difference in the types of patentee.The major entities are corporations and enterprises,and the proportion of individuals in micro-entities is rel atively high.From the point of view of patent life and patent maintenance time,it has pr ominent characteristics that the micro-entity was later divided,and the life of the small e ntity is the shortest.And this trend is consistent in different areas of technology.The summary summarizes the following three main conclusions: the entity size has a certain im pact on patent maintenance,the technical field has little impact on patent maintenance,a nd the patent maintenance fee becomes an effective tool to adjust the patent life.
