Study On The Countermeasures Of Improving The Quality Of Invention Patent In China

In recent years,with the further implementation of innovation-driven development strategy,China's intellectual property business has entered the best period of historical development,and there has been a new situation of popular entrepreneurship and innovation.This brings new challenges to China's efforts to speed up the construction of a strong intellectual property country.It also poses new challenges to the use and protection of intellectual property in China.Among them,improving the quality of patents,especially improving the quality of invention patents,has become the key to strengthening the use and protection of intellectual property.This article takes China's invention patent as the research object,firstly assuming that the universally-recognized factors affecting the quality of patent texts are the effective influencing factors for the quality of Chinese invention patent texts,and then selecting effective influencing factors for the quality of Chinese invention patent texts through empirical research methods.The conclusions indicate that the effective influencing factors mentioned above do not include:the number of manual pages,the number of technical features,the number of claims,and the number of applicants.Among them,100 Chinese invention patents whose patent right was invalidated by the Patent Reexamination Board in 2017 were samples of invention patent documents with low text quality.In Jiangsu Province,a sample of 100 outstanding invention patents for 2017 was a sample of high-quality invention patent documents.Then,based on the effective influencing factors of the quality of Chinese patents for invention patents,this paper analyzes the causes of the quality problems of patents for invention patents in China from the perspective of patent agents.Research findings:First,the distribution of patent agencies in China is uneven and the level of agency varies;Second,some patent agencies have a poor awareness of patent layout;Third,some patent agents have insufficient search for existing technologies;Fourth,some patent agents have value-oriented errors in the process of writing patent application documents,such as one-sided pursuit of the number of manual pages and the number of claims,and an inappropriate summary of technical features.In order to improve the status quo of the quality of Chinese invention patent texts,from the viewpoint of patent agents,specific countermeasures are proposed forrelated entities,including patent agencies and patent agents in the last chapter,and we hope to improve the text quality of our invention patents.Specifically include:First,guiding the balanced development of patent agencies in China;Second,nurturing high-quality patent agencies;Third,enhancing the awareness of the layout of our patent agencies;Fourth,righting the quality management system of patent agencies in China;Fifth,improving the access threshold for patent agents;Sixth,perfecting the quality assessment mechanism of patent agents.
