| The mobile phone,powered by big data,is no longer used as "prosthetic arm of communication " to extend the scope of personal senses,but to become the technology of “Alterity”,acting as a "tracker","collector" and "database" for personal privacy.As the private mobile phone is connected with the system like "global village",the private space of citizens becomes ambiguous between the public and private,and the private information flowing between them is trivial,secret and difficult to identify.As a result,the freedom rights that should be owned by individuals are subordinated to the invisible power.Ultimately,the privacy of citizens is placed in multiple dilemmas.As matters stand,this thesis selects the “privacy policy”,from domestic and foreign dominant apps,to analyze the content and framework,the boundary and buffer of rights,the commonness and difference between native texts and abroad texts,and the changes of different texts in the presentation of time.Further on,this thesis discusses the fuzzy areas of "multi-dimensional information collection","aggregated information application" and "information sharing between third parties" in the privacy policies,which demonstrate the tort action tendency of data holders.Then we can start from the external feasibility restriction path represented by law and seek for more effective protection.In conclusion,the last part focuses on the governance of the fuzzy zones,mainly involving information collection,processing and third-party sharing behavior.Combining the characteristics of mobile media and Daniel J.Solove's privacy model,this thesis attempts to build a legal mechanism model in the theoretical sense.From the individual level of positive intervention,the social level of common protection,the national level of regulation as breakthrough elements,to expand the scope of information protection mechanism,improve the operational mechanism of information protection mode,and finally achieve model construction. |
