The Rescarch On Karoshi’s Identification Of Work-related Injury

Since the last century at the end of 70s,after thirty years of reform and opening up,China has achieved great achievements in economy,people’s living level increased.However,during the period of rapid economic development,the social labor supply exceeds demand,the employment pressure of workers and the labor costs of enterprises and other factors,resulting in serious labor force.In order to avoid the obligation of the labor law,the enterprise implements the performance appraisal system,which urges the workers to work overtime voluntarily.For a long time,the body cannot get enough physical rest and overwhelmed,resulting in increased pressure on workers,the spirit of malaise.In the past ten years,the death rate of the workers in our country has been frequent,especially in recent years,the death of the workers in our country is too high.However,the legislation of "karoshi" is blank in our country.Firstly,this paper introduces the basic theoretical knowledge of "Karoshi",and then introduces the legal remedy path of "Karoshi".And then make an analysis and expression of the status of our country’s death from overwork and the possible adverse social consequences.Finally,by referring to the experience of Japan and the United States,come to an conclusion:In our country,"Karoshi"should be identified work-related injuries.And put forward legislative proposals from improvement of the existing industrial injury insurance system、the standards of "karoshi" and the agency of the identification.Hope to contribute meager strength to the legislation of karoshi and let the "karoshi" victim get legal protection earlier.
