Research On Copyright Infringement In Live Broadcast Of Online Games

With the coming of the era of 5G,live broadcasting,as a new business model with immediacy and interactivity,has been overwhelming in recent years and has entered people's lives.Subsequently,it also drives the development of "tiger teeth","douyu" and other major live broadcasting platforms and the popularity of the anchor industry.If live broadcasting is summed up in two words,it is "new" and "hot".Since 2016,online games represented by king of glory have also suddenly become active in people's entertainment life,and they have been gaining momentum in recent years.The combination of live broadcasting and online games has driven the popularity of online game live broadcasting industry.Live broadcasting enriches the lives of the people and promotes the development of the economy in a new way.However,laws cannot escape the lag,and live broadcasting is easy to become a hotbed of crimes,so some legal problems inevitably arise.This paper focuses on the online game live broadcast,which is a "new thing" with live broadcast as the transmission mode and online game as the content,and will deeply think and dig into the copyright infringement problem in online game live broadcast.Firstly,starting from the existing "miracle MU" case and "fantasy westward journey2" in judicial practice,this paper compares the current research status of online game live infringement at home and abroad,dialectically analyzes the shortcomings of domestic research,and learns from the advantages of foreign research.Secondly,this paper will clarify the legal relationship between game developers,game players and game anchors in online game live broadcast.In the author's opinion,the game developer,namely the game company,enjoys the copyright of the game picture.The copyright enjoyed by game players varies according to the type of game;The game webcast can enjoy the copyright of the live game.Finally,copyright infringement and unfair competition may compete,and in the determination of tort damage compensation should be analyzed from multiple factors.
