Research On Tibet's Legal System From 1876 To 1933

Tibet is an inalienable part of sacred Chinese territory since ancient times,all the past dynasties dynasty attached great importance to the governance of Tibet,among them "to hide under the rule of law" is always management an important means of Tibet.This article through to the Tibetan history known as the "The thirteenth",Tibet various legal documents to comb the theoretical system,On the basis of analyzing the achievements of legal system construction in this period,this paper objectively evaluates and analyzes the characteristics,experience and lessons of laws and regulations governing Tibet and related to Tibet,reveals the historical inheritance and innovative features of Tibetan laws in this period,and then gives theoretical enlightenment to the legal system construction in Tibet in the new era.Specifically,this paper includes the following five parts:The first chapter is the introduction.This paper mainly explains the background,research significance,time limit of topic selection,research status at home and abroad,research methods,innovation points and shortcomings of this paper.Chapter two is a comprehensive review of the Tibetan legal system during the period of the 13 th dalai lama.Research methods,the author USES the periodic history will xiii dalai lama to the major events that took place in leading to dalai lama,the second British war broke out,China was set up for the time node of the republic of China,from on macroscopic induces xiii dalai lama,the Tibetan local the phases of the construction of legal system,diversity,and transformative characteristics,and points out that the legal construction of xiii dalai lama,Tibet has given us the theory of enlightenment.The third chapter discusses the change of the relationship between the central government and the local government of Tibet from the perspective of the legal construction in Tibet.The author takes the life of the 13 th dalai lama as a time thread,and explains and analyzes the dynamic changes of the relationship between the central government and the local government of Tibet reflected by the unification of the legal system from his sitting on the bed to the second anti-british war period,after the xinhai revolution and the local legal system construction in his later years.Chapter iv reflects the destruction of the unity of state sovereignty from the signing of tibet-related international treaties.The writing of this chapter,the author to xiii dalai lama,the central government and Tibet local government of Tibet to sign the treaty to analyze this concept includes the judicial sovereignty of national sovereignty,economic sovereignty,sovereignty and the destruction of the three aspects,and according to current situation of the central government in Tibet for a series of legal reform.Chapter five is the conclusion of this paper.The author summarizes the theoretical interpretation of the third and fourth chapter,from xiii dalai lama,Tibet’s legal system reflects the relationship between the central government and Tibetan local government,from Tibet international treaties signed reflects the unity of national sovereignty is pointed out that investigation,especially the modern legal system development and changes of Tibet,Tibet to highlight in this paper,we study the theory of value.
