| Big Data refers to the data resources and knowledge serviceability formed by the integration,analysis,and sharing of data,which is based on massive multi-dimensional data and guided by value mining.Our state put forward the implementation of the national big data strategy at the Fifth Plenary Session of the 18 th CPC Central Committee,which closely combines informatization and social governance,providing a new direction for the informatization construction of the People’s Court.The People’s Court needs to keep abreast of the times,respond positively to the call of the state,make full use of modern science and technology such as big data,cloud computing,and artificial intelligence,and promote the modernization of judicial capacity and realize the highly intelligent operation of judicial adjudication.Big Data Technology is of great value to the courts in modernizing the judicial system and capacity.With the establishment of big data information platforms at all levels of the People’s Court and the constant development and maturity of technology,it has gradually formed the application forms of big data technology,such as electronic data information,intelligent judge assistance,unified system of judge prediction and sentencing,and expanded judicial openness and transparency.However,at present,the combination of big data and trial is still in a certain practical dilemma in the aspects of integration,data application,algorithm structure,and personnel training.While fully recognizing the long-term and arduous nature of big data in enhancing the judicial capacity,this paper starts with the theoretical and practical significance of big data in enhancing the judicial capacity,studied from the perspective of the current situation in theoretical research and the concrete application of the pilot court,combining the characteristics and nature of big data technology,and based on the actual judicial capacity of the courts at all levels in China,in order to break through the traditional judicial pattern and optimize the court’s trial ability comprehensively. |
