On The Legal Regulation Of The Police's Power Of Interrogation

As one of the important powers of police law enforcement,the power of the investigation is an important power conferred on the police by the law and plays an important role in maintaining the stability of social order.The People's Police Law of the People's Republic of China issued in 1995 clearly gave the police the power to conduct an investigation in the form of law for the first time.However,it mainly focused on the investigation effectiveness and there are still some defects in the regulation of the exercise of the power of investigation.It is not clearly defined what are the nature of the power of investigation,initiation criteria,enforcement procedures,supervision and relief.It is this existence of these non-standard defects that affects the implementation effect of interrogation power in practice.The abuse of police discretion is endless that civil rights are infringed and the images of police law enforcement are damaged.Based on the case analysis of abuse of police investigation power,this paper starts from the basic theory of police investigation,analyzes the problems existing in the regulation of police investigation in the current legislation,and combines the case analysis of the abuse of relevant police discretion to put forward the necessity of regulating the police investigation power.On the basis of the practical need to regulate the power of police investigation,this paper puts forward some suggestions on regulating the power of police investigation by drawing lessons from foreign experience.
