Bitcoin is a new thing that has been active in the field of currency in recent years.Because of its decentralization characteristics and the convenience and anonymity caused by the unique block chain technology,it has been sought after by the majority of believers.But everything has two sides.Anonymity,as a remarkable advantage of Bitcoin,also brings a series of problems,such as difficulties in legal supervision and facilitation of economic crimes.With the rapid development of Bitcoin,the exposed legal problems and market risks are increasing.Without effective regulation,the crisis of Bitcon will be enormous.Starting from the legal nature of Bitcoin,this paper analyses whether Bitcoin is a commodity or a currency.From the characteristics of Bitcoin,this paper analyses the difference between Bitcoin and common legal currency and the hidden danger of economic crime,especially the economic crime of money laundering with Bitcoin.On the other hand,combining with the supervision methods of Bitcoin in European and American countries,this paper analyses the practice of Bitcoin in China in detail,and puts forward some suggestions on the regulation of Bitcoin.First of all,we should make clear that the legal attribute of Bitcoin is commodity rather than currency.In legislation,we should clearly base on reality and clarify the principle of responsibility distribution.Secondly,we should strengthen the regulation of economic crimes,improve the electronic evidence system,clarify the jurisdiction of departments and international jurisdiction according to the characteristics of Bitcoin.Strengthen the control and supervision of market risk,establish Bitcoin credit system,establish Bitcoin market access rules,standardize third-party trading platform,etc.Proper taxation of Bitcoin can also mitigate the potential risks of Bitcoin slightly.
