Research On The Principle Of Reverse Consensus In The WTO Dispute Settlement Mechanism

The WTO dispute settlement mechanism established a principle in resolving disputes between countries,that is,the reverse consensus in this article.In the review of trade disputes,the traditional principle of consensus not only failed to make the disputes resolved efficiently,but also easily led to long delays in the trade dispute settlement mechanism,thus establishing the principle of reverse consensus.Since the establishment of the principle of reverse consensus,it has to be acknowledged that it does bring us certain benefits,but these benefits are not unlimited.It can be said that it is a double-edged sword: on the one hand,the principle of reverse consensus makes the WTO dispute settlement mechanism more judicial and predictable.It also played a significant role in the efficiency of dispute resolution and the deterrence of dispute resolution institutions.On the other hand,it also violates the requirements of fairness and makes the voting mechanism ineffective.It can be said that the principle of reverse consensus has been widely used since its establishment.It has achieved many remarkable achievements and played an effective role in safeguarding the settlement of WTO disputes.However,practice has proved that there is still much need to improve the principle of reverse consensus.Perfect place.In order to further improve the principle of reverse consensus and better determine the establishment goal and original intention of the principle of reverse consensus,the author puts forward some suggestions for perfection of the principle of reverse consensus.This article is to make a fuss about the lack of the principle of reverse consensus,the focus is to give some suggestions for the shortcomings.
