Investigation And Research On Migrant Workers' Labor Disputes From The Perspective Of Labor Arbitration

With the approaching of the 13th Five-Year Plan,China’s economic construction has entered a new stage of development.The development of economic construction is inseparable from the hard work of laborers,especially migrant workers.However,in view of the protection of the rights and interests of migrant workers,the state attaches great importance to the protection of the rights and interests of migrant workers by repeatedly issuing corresponding guiding opinions and requests to strengthen the protection of the rights and interests of migrant workers.Further observation,especially how to achieve these macro-designs in accordance with the law,properly and orderly,needs to be promoted through comprehensive public management behavior.As the primary and necessary link of the legal way to safeguard the rights of migrant workers,it is very necessary to study the actual effect of safeguarding the rights of migrant workers from the perspective of labor arbitration.This research is based on the analysis of the operation efficiency of the legal way to safeguard the rights of migrant workers represented by the arbitration channels of labor and personnel disputes.Through basic technical interviews,the main problems faced by the management field of migrant workers under the current environment are picked up,and the operation effectiveness of the stable and rational way to safeguard the rights of migrant workers is investigated.And the three core issues of irrational rights protection.Combining these three problems,this paper designs a questionnaire about peasant workers’rights protection,and distributes it to peasant workers who have consulted through the channels of arbitration auxiliary service,so as to obtain the concrete cognition of peasant workers to the current situation of peasant workers’ rights protection,finds out the shortcomings of peasant workers’current efficiency of rights protection,and gains the situation of peasant workers’ rights protection in this area.Got relatively complete first-hand data.In view of the problems found,combined with the relevant statistical situation and the basic principles of management,this paper systematically considers the basic causes of the problems of peasant workers’rights protection,and specifically examines the shortcomings of the legal path of rights protection.On this basis,this paper proposes three aspects to improve the effectiveness of peasant workers’rights protection:first,to improve the ability of both sides of labor relations to maintain the stability of labor relations through law-popularizing propaganda;second,to increase the operational effectiveness of the legal way of rights protection,try to protect the rights and interests of peasant workers in accordance with the law;third,to protect the rights and interests of peasant workers according to law;third,Effective regulation and control of the illegal path to safeguard rights,as far as possible to eliminate the choice and operational risks of the illegal path to safeguard rights,and ultimately promote migrant workers back to the legal track to safeguard their rights..
