| Pound is the founder of sociological law school.He elaborated his theory of social control through two articles,Social Control through Law and the Task of Law.From the angle of law and social control and civilization,he elaborated the difficult problem of "what is law".In Pound’s view,the transformation from liberal capitalism to monopoly capitalism is this theory.The inevitability of social control is determined by the contradiction between the nature of human self-expansion and the limitation of natural resources.This paper expounds the background of Pound’s social control theory when it came out,including the turbulent political background and the economic background of monopoly economy.It also combs the philosophical,sociological and legal origins of Pound’s social control theory.By discussing the relationship between civilization and social control,the task of law,the value of legal social control and the specific mechanism of social control process,Pound’s social control theory is fully embodied.Pound’s theory of social control has a good guidance and inspiration to our practice,but it also has some problems.Finally,the paper analyses the Enlightenment of Pound’s theory of social control to our country’s theory of rule of law and practice of rule of law. |
