Before the reform and opening up,China implemented the command planned economy formulated by the government.The human rights of enterprises and the right of workers to choose a job are in the hands of the state,thus forming the situation that the laborer only has a labor relationship with one employer in his whole life.Because of the widespread existence of this kind of situation,the concept of "single labor relationship" has been deeply rooted in people's hearts,and the regulation system of labor law is also based on "single labor relationship".In recent years,with the gradual improvement of China's economic system,the form of employment has also undergone earth-shaking changes,flexible employment with its own "elastic" characteristics of the workers and employers A unanimous agreement.However,there are still many problems in flexible employment while reducing employment pressure.Compared with traditional labor relations,the labor relations in flexible employment are not standard and perfect.Because this kind of non-standard labor relation is in blank state in our country's law stipulation,has produced many problems in the actual life.Sharing economy as a model of economic development gradually developed in recent years,in the process of rapid development in China,there have been many problems,the most obvious problem is the identification of labor relations.Supported by Internet technology and supported by the increasingly perfect credit system,the sharing economy with the purpose of reducing transaction costs around the efficient utilization of idle resources has established a resource-sharing platform for direct transactions between strangers.As an innovative economic model,sharing economy has not only broken the interest pattern of traditional economy,but also diversified the market subjects.At the same time,compared with the rapid development of Shared economy,corresponding legal system construction obviously lag,absence makes sharing economic legal liability system,market supervision system is not sound,makes out with the development of Shared economy and a lot of problem solving,not clear legal guidance,it also reflects the urgency of building Shared economic law regulation.In the process of rapid development of our country,the sharing economy has also produced many problems.The most obvious problem is the identification of labor relations.At the present stage,because the relevant laws and regulations of our country only adapt to the traditional economy,it leads to the service of the sharing economy.The relevant rights and interests of the providers themselves are not fully protected.This to a large extent,the sharing economy can not be stable development.This paper takes the concept of sharing economy and its related functions as the starting point,contrasts the different points of the labor relations under the sharing economy,combines with its characteristics,this paper discusses the labor relations under the sharing economy,and puts forward the countermeasures.
