Research On The Judicial Problems Of Rape Crime

The crime of rape is a crime of great social harm.It not only causes harm to the body of the criminal object,but also seriously infringes on the mental condition of the criminal object.Therefore,the crime of rape is stipulated in the laws of various countries in different periods,and heavier penalties are stipulated to severely punish the criminal subject,thus guaranteeing that people's sexual rights are not infringed.With the development of the times and social progress,the gender of the subject and object of crime stipulated in the current criminal law,as well as some specific special circumstances,no longer adapt to today's complex case situation,nor can the interests of victims be protected from infringement.In this paper,the author studies some difficult problems existing in the provisions of rape in our criminal law,compares and draws lessons from the provisions of rape in current criminal law of other countries,and puts forward feasible legislative proposals for rape in our criminal law.
