The Current Problems And Countermeasures In The System Of Medical Treatment Outside Prisons

As an important penalty enforcement system,the system of medical insurance has important significance for criminals,prisons and the whole society.On a humanitarian basis,it provides prisoners with the opportunity to be reintegrated into society without supervision,fully respecting and guaranteeing their basic rights to life and health as human beings,and saving national financial resources and reducing the prison burden.At the same time,it plays an important role in resolving social conflicts and promoting social harmony.Due to the dual nature of the system,if the prison is not strict in the examination and inspection of medical treatment,it will have a negative impact on judicial justice and authority and pose a potential threat to society.Such an important penalty enforcement system has been stagnant for a long time in practice.Although the 2014 Regulations on the Execution of Temporary Leave to Prison and the 2016 Regulations on the Procedures for the Execution of Temporary Leave to Prison have provided for a major overhaul and improvement of the system,I am a participant in the review of prison release.There are still some problems that need to be improved.The author analyzes the whole process and the whole process of medical treatment,and believes that the main problems are: First,the alienation of the motivation before the insurance,causing a strong "external impulse".The second is that the review of the insurance outside the middle school is complicated,and the scientific norm needs to be improved.The scientific nature of risk assessment needs to be improved,the risk of re-crime is difficult to control,the "life danger within a short period of time" is difficult to define,the assessment of medical conditions for foreign medical treatment needs to be improved,and the examination process for medical conditions for foreign medical treatment needs to be improved.The third is the lack of supervision after the insurance,the risk of runaway control is difficult to prevent.The responsibility of the guarantor is unclear,and the supervision function of the community correction institution needs to be strengthened,and it can not effectively manage the criminals.In this regard,the author proposes to improve the system of medical treatment for foreign patients in three stages: before,during and after the event.Mainly: with purification motivation as the core,completely curb the "external impulse." Take seeking truth from factsas the core and comprehensively improve the "review effectiveness." To strengthen supervision as the core,effectively prevent "out of control".This includes,inter alia,improving the medical security capacity of prisons and the community,revising the method for calculating prison sentences during the period of medical treatment on bail,establishing a hospice care system,and abolishing procedures for immediate medical treatment on bail.We will further improve the identification of medical conditions for medical treatment,improve the examination of medical conditions for medical treatment for medical treatment,clarify the vague concept,urge the guarantor to fulfill his responsibilities,and purify the work functions of community correction institutions.
