Discussion Of Right Of Medical Security Of Our Country’s Inmates

The prison inmates are being restricted or deprived of freedom rights, but it is notrestricted or deprived of all rights. They are human bings, still have a person who have thebasic human rights; They are citizens, still as that citizens enjoy many rights. Includinghealthy rights, not only is closely related to health for people, is closely connected withpeople’s right of life, also is one of that must be guaranteed citizens’ rights, and in themeaning of human rights. However,as they are prisoners, especially within China’s currentconditions, its medical rights didn’t get the attention as they deserve, just not get enoughprotection. Its performance is complex, the reason is unreasonable, needs to be discussedand seek the solution.In this paper, the main body of a total of five parts: the first is the author of theinmates questionnaire, what the statistical results reflects the inmates of the prison hospitalhold a widespread mistrust. This attitude shows a lot of problems, but the most importantissue is the prison’s medical treatment activity failed to fully ensure the rights to medicaltreatment. The next is the discussion of the prison medical disputes and analyzing itsreasons. Prison medical disputes, though of different kinds, but mostly associated with themedical rights can not be practically guaranteed of inmates, as dispute handling also doesnot favor the inmates. So, what problems exist in the prisoners right to health care, what isthe sticking point? This is the third part of this article. Not only in order to compare boththe practice of prison system in our country, but also provide that how to protect the healthright of prisoner in our country, the fourth part specifically introduces the international lawand the rule of law in developed countries such as Britain and America about protection of the health right of prisoner. The last part is trying to solve the problem of the protection ofthe health right for Chinese prisoners.The protection of the health right for Chinese prisoners guarantee a lot of problems,reason is very complex, both are in urgent need to be solved, and it will not be easy. Inspite of this, the author still attempts to do some summary, analysis and thinking,whichbased on his own actual work, so as to render Chinese prisoners right of medical guaranteededicated force.
