An Investigation Report On The Mechanism For The Diversion Of Complicated And Simplified Cases In The Judicial Reform

With the rapid development of our country’s economy,the social structure is constantly changing and upgrading,and the complicated social relations have made the contradictions and disputes rising rapidly.The lagging dispute settlement mechanism leads to the continuous flow of cases to the court.Under the background of the implementation of the registration system and the reform of the judicature,the contradiction of the court’s "few cases" becomes more and more obvious.Prominent,the grassroots court "litigation explosion" situation is difficult to overcome,the pressure of grassroots judges handling cases increases year by year.In order to break the contradiction of "few people and fewer cases",the reform of the split and distributary mechanism of cases is a breakthrough.The first batch of trial work of judicial reform in the first batch of courts in the country is close to the end.In order to understand the current situation and effectiveness of the implementation of the trial court in the reform trial,the author collects and collects H of G city through the practice investigation in the G district court.The number of judicial officers in the district court,the case acceptance and the examination and other related data,and to put forward the countermeasures and suggestions for the completion of the problems in the reform.The first part of the article includes the general situation of the court and the analysis of the data of the case collection,the main practice,the analysis and the basic results of the complicated distributary mechanism of the case,which provide the theoretical basis and data support for the following.The second part analyses the G city from three dimensions of civil cases,criminal cases,and execution cases.the third part,in view of the problems faced by the reform of the H District Court in the previous article,put forward the perfect countermeasures and suggestions from different angles of the three types of cases.Through the study of practice,this paper studies the reform of the simplified distributary mechanism of the court cases in the H District of G City,and put forward the corresponding suggestions,and hope that the results of this paper have the reference and reference value to the reform of the simplified distributary mechanism of the cases in the grass-roots courts of our country.
